BookPage.ai is a Next Level Web Design LLC company. If you subscribe, your billing statement may show Next Level or Next Level Web Design LLC.
Agreement to these Terms
These Terms of Service govern your access to and use of BookPage.ai, including our websites, landing page templates, dashboard, publishing tools, analytics, lead capture tools, AI features, support tools, integrations, and related services.
By creating an account, accessing the dashboard, previewing a page, subscribing, publishing a page, or otherwise using BookPage, you agree to these Terms and acknowledge our Privacy Policy. If you are using BookPage on behalf of a business, clinic, practice, or organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not create an account, subscribe, publish a page, or use BookPage.
BookPage and Next Level Web Design LLC
BookPage.ai is owned and operated by Next Level Web Design LLC. References to "BookPage," "we," "us," or "our" mean BookPage.ai and Next Level Web Design LLC.
Because BookPage is a Next Level company, subscription checkout, billing portals, invoices, receipts, and card or bank statements may reference Next Level, Next Level Web Design LLC, or a similar billing descriptor. You agree that this billing descriptor is not confusing, unauthorized, or fraudulent when associated with your BookPage subscription.
Description of the Service
BookPage is a software-as-a-service platform that helps businesses create, preview, publish, and manage industry-specific landing pages and related conversion tools.
Features may include templates, page editing, page previews, publishing, free BookPage subdomains, custom domain setup tools, analytics, call and click tracking, lead forms, form submissions, lead notifications, lead delivery, webhooks, CRM connection options, tracking pixel fields, AI support tools, patient or visitor education tools, support inbox tools, and administrative features.
You can create an account and preview your page before paying. Publishing a live page, keeping a page live, connecting some domain features, and using paid functionality require an active paid subscription unless we state otherwise in writing.
Your Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree to provide accurate account, billing, business, and contact information and to keep that information current.
You are responsible for ensuring that any team members, employees, contractors, marketers, or administrators you invite or allow to use BookPage comply with these Terms.
You must promptly notify us at support@gonextlevel.ai if you believe your account has been compromised or used without authorization.
Your Content, Words, Offers, and Claims
You are solely responsible for all content, words, claims, offers, images, videos, phone numbers, booking links, disclaimers, legal links, tracking scripts, pixels, CRM settings, webhook destinations, and other materials you add to or publish through BookPage.
You are responsible for reviewing default template content before publishing. Templates are starting points and may not be appropriate for your business, location, industry, licensing rules, advertising rules, professional obligations, or compliance needs.
You are responsible for the accuracy, legality, appropriateness, and compliance of your published page and related communications. This includes responsibility for what appears on the landing page, what your page says or implies, and how visitors, patients, customers, or leads are directed after interacting with the page.
BookPage is not liable for how you use the landing page, what words or claims are on the landing page, whether the content complies with your industry rules, or whether the page generates any leads, appointments, patients, sales, revenue, or other business results.
Healthcare, Wellness, and Professional Services Disclaimer
Some BookPage templates and tools may relate to healthcare, wellness, medical-adjacent, therapy, chiropractic, pain relief, SoftWave, or other professional services. BookPage does not provide medical advice, legal advice, advertising compliance advice, privacy compliance advice, diagnosis, treatment recommendations, clinical guidance, or professional judgment.
Any educational content, template language, AI-generated response, form question, disclaimer, or landing page structure is general informational material only. It is not a substitute for review by a qualified attorney, compliance advisor, healthcare professional, licensing board, or other appropriate professional.
Providers are solely responsible for ensuring that their pages, ads, offers, forms, lead handling, patient communications, and follow-up processes comply with applicable federal, state, local, professional, healthcare, advertising, privacy, and patient communication laws and rules.
AI Features and Generated Output
BookPage may include AI-powered features, including support chat, educational chat, content assistance, summarization, and other automated responses. AI output may be incomplete, inaccurate, repetitive, outdated, or inappropriate for your specific situation.
You are responsible for reviewing, approving, editing, and monitoring AI-generated or AI-assisted content before relying on it or allowing it to affect visitors, patients, customers, leads, or business decisions.
AI features should not be used as a replacement for professional medical, legal, financial, advertising, compliance, or clinical advice. We are not responsible for decisions made based on AI output.
Subscriptions, Billing, and Cancellation
Paid subscriptions are processed through Stripe or another payment processor we may use. By subscribing, you authorize recurring charges for the selected plan until the subscription is canceled.
You are responsible for taxes, payment method accuracy, failed payments, chargebacks, and maintaining a valid payment method.
You may manage billing, update payment methods, view invoices, and cancel through the billing portal when available in your dashboard. If the billing portal is unavailable or you need help canceling, contact support@gonextlevel.ai.
Canceling stops future recurring billing according to the subscription terms shown at checkout and in Stripe. Cancellation does not automatically create a refund, credit, damages claim, or compensation right.
If payment fails, if a charge is reversed, or if your subscription becomes inactive, we may suspend, unpublish, restrict, or remove access to paid publishing features, domain routing, lead delivery, integrations, or other paid functionality.
Refund Policy
Refunds are handled case by case. We do not standardly offer refunds unless a refund is requested within 30 days after the account or subscription has been canceled.
A request for a refund does not guarantee approval. We may consider billing timing, account usage, duplicate charges, technical issues, support history, cancellation timing, platform abuse, chargeback history, and any other relevant circumstances.
Glitches, downtime, bugs, feature changes, user error, setup delays, third-party issues, low conversion results, lack of leads, lack of appointments, lack of patients, dissatisfaction with marketing performance, or failure to use the platform do not automatically entitle you to a refund, credit, compensation, or damages.
Approved refunds will generally be returned to the original payment method through Stripe or the applicable payment processor.
Software-as-a-Service; No Perfect Operation
BookPage is an evolving software-as-a-service product. We are actively building, improving, updating, testing, and changing the platform over time.
You understand that software and internet services may experience bugs, errors, downtime, delays, display issues, email delivery issues, analytics gaps, tracking inaccuracies, integration failures, AI mistakes, domain propagation delays, browser differences, mobile display issues, or other interruptions.
If you experience a glitch, bug, problem, or unexpected behavior, you agree to notify us and give us a reasonable opportunity to investigate and address the issue. The existence of a bug, glitch, outage, or imperfect feature does not automatically create a refund right, service credit, compensation right, damages claim, or breach of contract.
We may add, remove, modify, rename, replace, limit, test, or discontinue features at any time. We may make changes for product improvement, security, compliance, business, technical, or user experience reasons.
No Guarantee of Results
BookPage does not guarantee leads, appointments, patients, sales, revenue, ad performance, search rankings, conversion rates, phone calls, form submissions, calendar bookings, or any specific business outcome.
Your results may depend on many factors outside our control, including your offer, market, reputation, pricing, advertising, traffic quality, location, follow-up speed, sales process, staff, competition, website content, compliance restrictions, third-party platforms, and visitor behavior.
Any examples, screenshots, metrics, demonstrations, or marketing materials are illustrative only and do not promise that you will achieve the same or similar results.
Domains, DNS, Tracking, CRMs, and Third-Party Services
BookPage may provide free BookPage subdomains and tools for connecting custom domains. Domain routing, DNS records, SSL certificates, browser caching, and third-party provider settings can depend on outside systems and may require time to update.
If you connect advertising pixels, analytics tools, CRMs, webhooks, Zapier, Make, GoHighLevel, Google, Meta, TikTok, or other third-party services, you are responsible for those providers, credentials, permissions, settings, compliance obligations, and downstream use of data.
We are not responsible for failures, outages, policy changes, data handling, billing, security, restrictions, or errors caused by third-party services.
Lead Data and Visitor Communications
If your page collects leads, form submissions, phone clicks, booking clicks, chat messages, or other visitor interactions, you are responsible for how you use, contact, store, export, disclose, and follow up with those leads.
You are responsible for complying with applicable consent, texting, email, telemarketing, healthcare, privacy, advertising, and patient communication rules, including any rules that apply to your industry or location.
BookPage is not responsible for the legality, timing, content, accuracy, or outcome of your follow-up communications.
Acceptable Use
You agree not to use BookPage for unlawful, misleading, abusive, infringing, harmful, deceptive, discriminatory, spam-related, malware-related, or fraudulent activity.
You may not attempt to reverse engineer, disrupt, overload, scrape, bypass security, misuse APIs, access other users’ accounts, interfere with the service, or use BookPage in a way that creates legal, security, reputational, or operational risk for us or others.
We may suspend or terminate access, remove content, disable integrations, or unpublish pages if we believe your use violates these Terms or creates risk.
Intellectual Property and License
You retain ownership of the business content you provide to BookPage. You grant us a worldwide, non-exclusive license to host, display, process, transmit, modify, copy, and use that content as needed to provide, secure, support, and improve the service.
BookPage templates, software, platform design, workflows, dashboard designs, AI instructions, documentation, brand assets, code, systems, processes, and underlying technology are owned by BookPage, Next Level Web Design LLC, or their licensors.
You may not copy, resell, clone, sublicense, redistribute, or create competing products from the BookPage platform, templates, dashboard, software, or proprietary materials except as expressly allowed by us in writing.
Privacy and Data Protection
Our Privacy Policy explains how we collect, use, share, and protect information. By using BookPage, you acknowledge the Privacy Policy.
You are responsible for providing your own privacy policy, terms, disclaimers, consent language, and other legal notices on your published page where required for your business, location, visitors, tracking tools, lead collection, or industry.
Disclaimers
To the fullest extent allowed by law, BookPage is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, accuracy, reliability, security, availability, and that the service will meet your requirements or produce any particular result.
Limitation of Liability
To the fullest extent allowed by law, BookPage, Next Level Web Design LLC, and our owners, employees, contractors, vendors, affiliates, and service providers are not liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost goodwill, lost data, lost leads, lost appointments, lost patients, lost sales, business interruption, advertising spend, replacement services, third-party claims, or platform performance issues.
We are not liable for how you use a landing page, what words or claims appear on your landing page, whether your page complies with applicable rules, whether your page converts visitors, whether you receive leads, whether leads become patients or customers, or whether your business achieves any outcome.
To the fullest extent allowed by law, our total liability for all claims related to the service will not exceed the amount you paid to BookPage in the three months before the event giving rise to the claim, or $100 if you have not paid us during that period.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless BookPage, Next Level Web Design LLC, and our owners, employees, contractors, vendors, affiliates, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your content, your landing page, your use of the service, your leads or visitor communications, your third-party integrations, your violation of these Terms, your violation of law, or your infringement or misuse of another party’s rights.
Termination and Suspension
You may stop using BookPage and cancel your subscription at any time through the billing portal when available or by contacting support.
We may suspend or terminate access, unpublish pages, restrict features, remove content, or disable integrations if an account violates these Terms, fails to pay, creates legal or security risk, abuses the platform, causes operational issues, or misuses third-party services.
After termination or cancellation, we may retain certain information as described in our Privacy Policy and as needed for legal, security, backup, dispute, tax, billing, fraud prevention, and business record purposes.
Changes to these Terms
We may update these Terms from time to time by posting a revised version on this page. The updated Terms will show a new effective date.
Your continued use of BookPage after updated Terms are posted means you accept the updated Terms. If you do not agree to updated Terms, you must stop using BookPage and cancel your subscription.
